MAPP1 Phase 3 trial of MDMA-assisted therapy for PTSD meets its primary endpoint
E-0002
Criterion

TRUE on the date of the sponsor's topline release, the ClinicalTrials.gov results posting or the peer-reviewed publication that first reports that MAPP1 (NCT03537014), the first Phase 3 trial of MDMA-assisted therapy for PTSD, met its prespecified primary endpoint (change in CAPS-5 total severity score versus placebo with therapy) with statistical significance as reported by the sponsor. FALSE on the date the sponsor first reports that the primary endpoint was not met, and FALSE at the deadline when no primary-endpoint result has been reported. Secondary endpoints, interim analyses and pooled analyses do not count. I tried to move the date. The 2020 interim analysis is excluded by the criterion. MAPS's release of 2021-05-03 reports a significant reduction on the primary PTSD-severity measure versus placebo with therapy (p<0.0001); Nature Medicine published the paper on 2021-05-10; ClinicalTrials.gov results were first submitted 2021-08-18 and posted 2021-09-16. I found no earlier public report: MAPS's own 2021-05-21 summary says the results were announced May 3 and published May 10. The release came from MAPS, the parent of sponsor MAPS PBC, which the criterion accepts as the sponsor's topline release. Occurred on 2021-05-03 stands.

A Phase 3 trial of a psychedelic-assisted psychotherapy meets its primary endpoint
E-0074
Criterion

TRUE on the date of the first sponsor topline press release, ClinicalTrials.gov results posting or peer-reviewed publication that reports a Phase 3 trial of a psychedelic drug (MDMA, psilocybin, LSD or another classic psychedelic or entactogen) given with psychotherapy, for any indication and under any sponsor, as having met its prespecified primary efficacy endpoint with statistical significance as reported by the sponsor. Phase 2 trials, secondary endpoints, interim analyses and pooled analyses do not count. Resolution source: the sponsor's topline release, with ClinicalTrials.gov results for the same trial. Case against 2021-05-03: the readout that counts could be the Nature Medicine paper of 2021-05-10, or an earlier Phase 3 of another psychedelic given with psychotherapy. Both fail. The MAPS page of 2021-05-03 is the sponsor's own topline release and states the prespecified primary endpoint was met, CAPS-5 severity falling more with MDMA-assisted therapy than with placebo plus therapy at p<0.0001; the criterion takes the first of release, results posting or publication, so the release precedes the paper of 2021-05-10 and the ClinicalTrials.gov results submitted 2021-08-18. No earlier candidate exists: MAPP1 (NCT03537014) is the first Phase 3 in the class, started 2018-11-21, and the only earlier Phase 3 psychotherapy-paired readouts are esketamine, which is neither a classic psychedelic nor an entactogen and was not given with psychotherapy. State and date stand.

DEA registers a research-cannabis producer other than the NIDA contractor
E-0073
Criterion

TRUE on the date the DEA issues a Schedule I bulk manufacturer registration for the manufacture of marijuana for research to any applicant other than the NIDA contract facility at the University of Mississippi, as published in the Federal Register or announced by the DEA Diversion Control Division. Case for an earlier date: NPR, MJBizDaily and law-firm posts all report that DEA 'approved' Scottsdale Research Institute and Biopharmaceutical Research Company in May 2021, and DEA's own 2021-05-14 story says growers were being brought on. If any of that was a registration, the first-true date is May 2021, not 2021-06-26. The case fails on the documents. The Yetter Coleman post of 2021-05-26 says SRI received a draft agreement, i.e. a memorandum of agreement, which the criterion excludes. DEA's Notices of Registration are the registrations: Groff NA Hemplex LLC (DRG-21-0191/DRG-21-0065, answering 85 FR 21889) and Biopharmaceutical Research Company LLC (DRG-17-0182/DRG-19-0034, answering 84 FR 44920) are both dated 6/26/2021. A separate BRC notice at DRG-17-0182 is dated 9/8/2021, later. SRI's own bulk-manufacturer notice is 2022. No 2021 notice predates 26 June.

DEA grants the Schedule I registration for the Bronx VA MDMA-assisted therapy PTSD study
E-0084
Criterion

TRUE on the earliest of (a) the date the sponsor (MAPS or MAPS PBC), the Bronx VA or the study's investigators publicly state that the DEA registration for the Bronx VA MDMA-assisted therapy for PTSD study has been granted, (b) the date a sponsor or VA announcement reports that the study has begun dosing or enrolling participants at the Bronx VA (dosing MDMA requires the registration), or (c) the date ClinicalTrials.gov first lists the Bronx VA site for that study with status Recruiting. A statement that the registration is pending, an IRB approval or a protocol approval is not the DEA registration. Case for an earlier date: the same record gives an actual study start of 2021-11-08, eight days earlier, and dosing MDMA needs the registration, so the grant is earlier still; the MAPS site-initiation post of 2021-09-22 could also be read as the study beginning. The record history refuses both. Version 4, submitted 2021-11-09 and posted 2021-11-10, still shows overall status NOT_YET_RECRUITING, no site listed, and an estimated start of 2021-12-18. Version 5, submitted 2021-11-16 and posted 2021-11-17, is the first to show status RECRUITING, the James J. Peters VA Medical Center site RECRUITING, and the actual start of 2021-11-08. Criteria (b) and (c) both key on the date of the announcement or listing, not on the event reported, so 2021-11-17 is the first verifiable date. No MAPS statement announces the grant; the Winter 2021 bulletin (15 March 2021) still calls it pending.

The 2023-01-05 release (PR Newswire and mapsbcorp.com) says MAPP2 'met both the primary endpoint as measured by the change from baseline in CAPS-5 and the key secondary endpoint', but it gives no p-value and never says 'statistically significant'; the parent MAPS post of the same day gives no efficacy statistic at all. One could push the date to the Nature Medicine paper (2023-09-14, P<0.001) or the ClinicalTrials.gov results posting (2023-10-11). I do not: a sponsor's statement that a trial 'met' its prespecified primary endpoint is the standard report that the prespecified test reached significance, the publication confirmed it, and the criterion accepts significance 'as reported by the sponsor'. No earlier disclosure exists; the 2022-11-17 completion release only promised topline results in Q1 2023. Occurred on 2023-01-05 stands.

The recorded date relies on NCT05163496 being 'registered as Phase 3'. Its ClinicalTrials.gov version history shows otherwise: the versions of 2021-12-06, 2021-12-17 and 2022-07-13 list Phase 1/Phase 2, and the July 2022 version already carries the actual start date 2022-03-03; the Phase 3 label first appears in the 2023-05-17 version, fourteen months after the start. So on 2022-03-03 a trial registered as Phase 1/2 started, and no psilocybin trial registered as Phase 3 had started. The first psilocybin trial registered as Phase 3 when it started is COMPASS's COMP005 (NCT05624268), posted 2022-11-22 as Phase 3 with actual start 2023-01-24; no sponsor first-patient release predates that, and the ClinicalTrials.gov Phase 3 search shows no other candidate before it. The first-true date moves to 2023-01-24; the state is unchanged.

A US health plan covers accelerated TMS for PTSD, bipolar disorder, OCD or ADHD

Criterion

TRUE on the effective date of a published medical policy, coverage bulletin or fee schedule from a US health plan (a Blue Cross Blue Shield plan or another commercial or public payer) that lists an accelerated TMS protocol (multiple sessions per day, such as SAINT/SNT or SWIFT) as medically necessary for at least one of post-traumatic stress disorder, bipolar disorder, obsessive-compulsive disorder or attention-deficit/hyperactivity disorder. Attacked the 2023-02-03 date. The Premera policy history in the 2026-08-01 PDF does support it: the 11/01/22 entry says changes effective Feb. 3, 2023 made standard and deep TMS medically necessary for OCD and added criteria for accelerated intensive TMS. But the 2023 text gated accelerated TMS on hardship. The 05/01/23 entry adds hardship examples, and the 01/01/26 entry (approved 2025-12-09) says coverage was expanded 'by removing the hardship requirement'. So in 2023 Premera allowed a compressed schedule for a conventional course, not an accelerated protocol; SNT/SAINT was, and still is, investigational, and SWIFT was named medically necessary only on 2026-08-01. BrainsWay's 2026-01-07 release calls the January 2026 Premera policy the first coverage policy for accelerated deep TMS, which contradicts a 2023 first-true date. Candidate alternative: 2026-01-01. The sources conflict on what counts as a protocol.

The criterion fixes the date at the DEA announcement date when it is earlier than Federal Register publication. The resolver used DEA's press release of 2023-05-09 on the temporary rule (filed 2023-05-09, published 2023-05-10, effective 2023-05-11). DEA made an earlier public announcement: the Administrator's statement of 2023-05-03 (dea.gov, dated in its URL and quoted by K&L Gates and trade press; dea.gov refuses automated fetches) said DEA had received a record 38,000 comments and 'we have decided to extend the current flexibilities while we work to find a way forward'. Read as the DEA announcement of the extension, the first-true date is 2023-05-03. Read strictly, the statement announced a decision but no rule or order, and the rule was first announced on 2023-05-09. The criterion does not say which announcement counts. The state is unaffected; the date needs a ruling.

I tested whether the date should be the publication date (2023-08-28) or the display date (2023-08-01) rather than the effective date, and whether the approval was final. The FY 2024 IPPS/LTCH PPS final rule (88 FR 58640) states 'we are finalizing that the maximum new technology add-on payment for a case involving the use of the SAINT Neuromodulation System is $12,675.00 for FY 2024', with cases identified by ICD-10-PCS X0Z0X18, and 'DATES: This final rule is effective October 1, 2023.' The criterion names the effective date, so 2023-10-01 is correct. No earlier IPPS rule approved an NTAP for SAINT; FDA clearance came 2022-09-06, after the FY 2023 application cycle. The rule also records the applicant's statement that SAINT would be commercially available on 2024-04-15, which bears on the newness period, not on approval. Occurred on 2023-10-01 stands.

The recorded date is too late. The criterion counts 'a Medicare fee schedule or add-on payment', and Medicare was already paying for SAINT nine months before the July 2024 OPPS update. In the FY2024 IPPS/LTCH final rule, published 2023-08-28 and effective 2023-10-01, CMS states: 'we are finalizing our proposal to approve new technology add-on payments for the SAINT Neuromodulation System for FY 2024', sets the maximum add-on payment at 12,675.00 US dollars per case (65 percent of a 19,500.00 cost per case) and names ICD-10-PCS code X0Z0X18 for eligible cases. That is a published Medicare payment policy with an effective date, dated after 2022-09-07, not a bare code assignment. Magnus confirmed on 2024-04-30 that it held the NTAP. The 2024-07-01 OPPS assignment (status S, APCs 1511 and 1522, confirmed in Transmittal 12665) is real but second.

Read literally, criterion (a) is met there, five years earlier. The record defeats the reading: the summary says it is 'an add-on substudy to an already-approved clinical trial' NCT03537014, the MAPS trial MAPP1, with MAPS as collaborator. USC collects saliva; the drug arms it lists are the parent trial's. It generates no MDMA-for-PTSD clinical data of its own, which the reading requires. A weaker attack on NCT05979844, that Resilient (ex-Lykos) supplies drug as a collaborator, also fails: the criterion excludes only MAPS, MAPS PBC, a successor or a licensee, and Dr. Leslie Morland is the sponsor. Phase 3, actual start 2023-10-06 confirmed.

A state attorney general is a named enforcement agency, and the criterion fixes an agency settlement's date by the agency press release. I found no earlier qualifying action: the N.D. CMS's FY 2024 IPPS final rule records the applicant telling CMS that SAINT 'will be commercially available on April 15, 2024', and UAMS's 'first in the nation to offer' release is dated 2024-06-11; neither is a Magnus press release, the only source the criterion accepts. MUSC in fact treated patients first: its article of 2024-08-09 (musc.edu) says MUSC was 'the first hospital system in the country to actually perform the SAINT method for patients in May' 2024; the Post and Courier (2024-08-19) agrees. But the criterion keys on the announcement date, and MUSC's first public announcement came 2024-08-09, after the UAMS release of 2024-06-11, which states SAINT 'can only be provided to patients who are being treated as inpatients'. No hospital or Magnus announcement of patient availability between 2024-04-30 and 2024-06-11 was found. 2024-06-11 stands; UAMS's 'first' claim is wrong in fact but not in date.

Attacked the criterion and the 2024-07-01 date. The IBX facts hold: the provider notice revises 07.03.22f and MA07.035e to make accelerated theta burst stimulation (SAINT, 10 daily sessions over five days) medically necessary, retroactively effective 2024-07-01, with the final policy issued 2024-12-02. Two problems. First, 2024-07-01 is a retroactive effective date; no policy was published on that day, and the notice carries no publication date in the evidence, so 'the effective date of a published medical policy' is strained. Second, and larger, the criterion resolves TRUE almost two years before the 2026-05-16 statement it scores. The forecaster said 'more to come' after listing seven plans; a policy already in force in 2024 shows the list was incomplete, not that the forecast came true. The resolver also concedes that earlier policies from other plans were not ruled out, so 2024-07-01 is not established as first-true.

TRUE on the date of the first sponsor topline release, ClinicalTrials.gov results posting or peer-reviewed publication dated after 2022-07-11 that reports a randomized controlled trial of SNT (Stanford Neuromodulation Therapy, the accelerated intermittent theta-burst TMS protocol commercialized by Magnus Medical) or another accelerated iTBS protocol for a depressive disorder, distinct from the Stanford SNT trial already published at the statement date, in which the prespecified primary efficacy endpoint met statistical significance versus the control arm as reported by the sponsor or the authors. Open-label series, secondary endpoints and pooled analyses do not count. PubMed shows no qualifying multi-daily theta-burst RCT in depression from 2022-07-12 to 2024-07-10: Wilkening 2022 and Li 2023 missed their primary endpoints; Kong 2023 was a non-inferiority trial of V1 versus DLPFC with no sham arm; Huang 2024, Zhang 2024 and Mallik 2022 were not significant. So Sheline et al. (JAMA Psychiatry online 2024-07-10; 10 sessions a day for 5 days; MADRS -14.75 versus sham, P<.001) is the first positive RCT, but its population is treatment-refractory bipolar depression. The criterion says "a depressive disorder"; DSM-5 files bipolar disorders in a separate chapter, while the proposition says "for depression" and the registered conditions include treatment-resistant depression. If bipolar depression is excluded, the next candidate is Ramos et al. (online 2025-03-05; TRD; 3 sessions a day for 15 weekdays), outside the "about five days" reading. The readings differ by eight months; the criterion does not settle it.

The trial facts hold: the University of Pennsylvania RCT (NCT05228457) was randomized, triple-masked and sham-controlled, used 10 sessions per day for 5 days, and met its prespecified MADRS primary outcome (active 30.4 to 10.5, sham 28.0 to 25.3; difference -14.8, P<.001; 24 analysed), first published in JAMA Psychiatry on 2024-07-10, with results posted on 2025-03-12. The criterion clause that fails is 'dated after the statement date'. The resolver says it cannot see that date, and neither can I. Every other case in this packet resolves on 2025 or 2026 evidence, so a 2024-07-10 publication is likely to predate the statement it resolves; if it does, this report cannot make the event TRUE and the event is still open. Note also that the trial has no commercial sponsor, so 'sponsor topline release' maps onto an investigator publication.

FDA challenges the midomafetamine (MDMA-assisted therapy) Phase 3 results over an unsuccessful double-blind
E-0075
Criterion

TRUE on the date of an FDA written action (complete response letter, refuse-to-file letter or other written FDA communication the sponsor discloses), an FDA review document posted on Drugs@FDA, or an FDA advisory committee briefing document that names failure or loss of the double-blind (functional unblinding, or expectancy bias from unblinding) in the Phase 3 trials of midomafetamine (MDMA-assisted therapy) for PTSD, under any sponsor name, as a reason the efficacy results are not adequate for approval. A document that only asks a question about blinding, without treating it as a deficiency, does not count. The state is safe: the complete response letter for NDA 215455 does name functional unblinding as a deficiency, saying participants with prior midomafetamine use are 'more likely to recognize the effects of midomafetamine (i.e., leading to functional unblinding)', and that 'These limitations impact the interpretability of MAPP1 and MAPP2 and ... preclude the ability to establish substantial evidence of effectiveness.' The date is wrong. The criterion fixes TRUE on the date of the FDA written action, not the date the sponsor disclosed it. FDA's released letter carries one date only: the electronic signature reads 08/08/2024 02:39:42 PM, and openFDA records letter_date 08/08/2024. The sponsor release of 2024-08-09 is secondary. The same registry dates the same letter 2024-08-08 at E-0090. The earlier 2024-06-04 briefing document does not qualify: it poses questions and calls the two studies positive.

Case for 2024-08-09: the criterion dates the action 'as dated in Drugs@FDA or announced by the sponsor', and Drugs@FDA carries no action letter for an unapproved NDA, which would leave the sponsor's announcement of 2024-08-09 as the only admissible date. The argument fails because the event is the FDA's first action letter, and that letter carries its own date. FDA's released letter for NDA 215455 is signed electronically 08/08/2024 02:39:42 PM, and the openFDA transparency CRL dataset records letter_date 08/08/2024 for Lykos Therapeutics, status Unapproved. The sponsor's 2024-08-09 release reports receipt, one day later. No earlier action exists: the NDA was accepted for filing with priority review, so no refuse-to-file letter intervenes, and the June 2024 advisory committee is excluded by the criterion.

Criterion

TRUE on the date the sponsor (Lykos Therapeutics) publicly discloses, or the FDA publicly states, that the FDA's action letter on the midomafetamine NDA under review on the statement date cites insufficient or missing safety data or requests additional safety data, alone or together with other deficiencies. FALSE on the date the FDA approves that NDA in the pending review cycle, on the date the sponsor's or the FDA's disclosed summary of the action letter names only deficiencies that do not concern safety data, or at the deadline when no FDA action letter on that NDA has been disclosed. Argued that Lykos's 2024-08-09 disclosure names only non-safety grounds (durability, expectancy bias, psychotherapy) and that a request for a new trial is not a request for safety data. It fails: the release (PR Newswire, 2024-08-09 17:27 ET) says the FDA 'requested that Lykos conduct an additional Phase 3 trial to further study the safety and efficacy of midomafetamine', a request for additional safety data with other deficiencies, so the FALSE branch ('only deficiencies that do not concern safety data') does not apply. The letter, signed 2024-08-08 14:39 and published by FDA on 2025-09-04, confirms it: the NDA did not 'establish the safety', unreported adverse events raise 'substantial concerns about the reliability of the safety data', Phase 3 laboratory data were missing, and FDA asked for a new trial to 'adequately characterize the safety'. The letter date is earlier, but the criterion keys on the sponsor's disclosure, and FDA said nothing publicly before 2025. 2024-08-09 stands.

I argued that the 2023 proposal was never revised, withdrawn or replaced: no withdrawal notice exists, and the 2025-01-17 NPRM never uses the words withdraw, supersede or replace. The text of 90 FR 6541 defeats this. It is issued under the same RIN 1117-AB40 and docket DEA-407; it says DEA 'reevaluated its approach and determined that the best course of action was to proceed with the promulgation of a Special Registration rule', which 'no longer contains an in-person medical examination requirement for certain substances' nor the 30-day supply limit; and its Regulatory Alternatives section lists 'finalizing the proposed March 2023 General Telemedicine NPRM' as a rejected alternative. That is a new proposal that supersedes the 2023 one. The same-day VA final rule (90 FR 6523; RIN 1117-AB40; docket DEA-2023-0029) partially finalizes the rulemaking on different terms, also on 2025-01-17. Nothing earlier in the docket qualifies. TRUE on the date of the first Johnson & Johnson report that shows Spravato worldwide net sales at or above US$1 billion for a calendar year. Case for an earlier date: Spravato sales were running above US$250 million a quarter through 2024, so a rolling four-quarter total crossed US$1 billion inside 2024, and the Q3 2024 Form 10-Q would then be the first report showing it. The criterion blocks this: it asks for Spravato worldwide net sales at or above US$1 billion 'for a calendar year' in the named series, and no J&J report before the 2024 full-year figures states one. The Form 8-K Exhibit 99.2 supplementary sales data filed 2025-01-22 gives SPRAVATO worldwide US$1,077 million for full-year 2024 against US$689 million for 2023, up 56.4%. 2023 is below the threshold, so 2024 is the first qualifying calendar year and 2025-01-22 the first report of it. The FY2024 Form 10-K of 2025-02-13 repeats it; FY2025 at US$1,696 million confirms the series. State, date and realized value stand.

If any of that was a completed financing, the first-true date is months earlier. It was not. The January and March reports describe a plan and a takeover in progress, which the criterion excludes as a letter of intent or rumour, and neither is a sponsor announcement. The first definitive sponsor announcement of a completed financing is the Lykos release of 2025-05-30, first close of a Series B, US$50 million, co-led by the Gracias Family Foundation and the CH Foundation; Psychedelic Alpha reports the same amount, investors and date. Earlier COMP005 releases in 2025 announced completion of recruitment and completion of Part A dosing only, with no primary estimate, which the criterion excludes. Argued not_occurred on the criterion words 'at the primary timepoint'. The Phase 2b primary timepoint is Day 29; the 2025-09-23 Phase 2a two-dose release reports Day 2, Day 8, one week after the second dose and Week 12, but no Day 29 value, so a strict same-timepoint comparison has no matching number. The argument fails on the size of the gap. Phase 2b single active doses: 12.1 points (8 mg) and 11.1 points (12 mg) at Day 29. Phase 2a two-dose induction (8 mg then 12 mg): 19.0 points one week after the second dose and 13.7 points at Week 12, both larger than either single-dose estimate; even the pre-second-dose Day 8 value, 12.9, exceeds them. The criterion's operative sentence is wider than the asset. Three sponsor releases meet that wording before 2025-11-10: 2024-03-27, initial Phase 2a open-label results (mean MADRS reduction 18 points at day 1, 19 at one month, 18 at three months); 2025-05-20, Phase 2a Part 2 with SSRIs; and 2025-09-23, the Phase 2a two-dose induction (NCT05660642, open-label, 13.3, 12.9, 19.0 and 13.7 points). TRUE on the date of the first peer-reviewed publication (PubMed-indexed) or ClinicalTrials.gov results posting, dated after 2026-01-15, that reports primary-outcome results of a randomized controlled trial of the Monarch eTNS (external trigeminal nerve stimulation) device in one of the indications the forecaster names as cleared (ADHD in youth, or refractory seizures), designed to test the efficacy finding of the trial that supported the existing FDA clearance, and randomizing more participants than that pivotal trial. Argued the date is wrong or the trial does not qualify. Three attacks failed. (1) Device: the PMC full text names the Monarch TNS System (NeuroSigma), the cleared device. (2) Size and design: ATTENS randomized 150 (75/75) against 62 in McGough 2019 (NCT02155608), the trial behind the April 2019 FDA clearance, and is described as a confirmatory replication, so it meets 'larger' and 'designed to test'. (3) Date: the window edge is tight, because the criterion needs a date after 2026-01-15 and the paper is Epub 2026-01-16. The Nature Medicine DOI carries a 2025 stem (s41591-025-04075-x), so I checked for an earlier online date; PubMed, PMC and Nature all give 16 January 2026, print Feb 2026;32(2):582-590. Nothing qualifying falls in the one-day gap, and UCLA NCT05374187 (n=218) has posted no results. The null primary result does not matter, because any direction counts.

Attacked the date. Earlier: PubMed (E-utilities) shows no journal publication of NCT04593875, and the only pallidal tFUS trial paper in Parkinson's disease (Lin, Mov Disord, epub 2025-10-23) used a Taiwanese device, not Brainsonix. Of 26 tFUS papers dated 2026-01-01 to 2026-02-04, none is a peer-reviewed patient trial of a Brainsonix device: Schachtner (Front Psychiatry, 2026-01-20) used an Openwater device, Subramaniam (medRxiv, 2026-01-13) is a preprint, the coupling-pad paper is preclinical. ClinicalTrials.gov lists 22 Brainsonix or BX Pulsar studies and only NCT04593875 has results posted after 2026-01-01 (first posted 2026-02-04; UCLA; BX Pulsar 1002; 31 Parkinson's patients; randomized sham-controlled crossover; UPDRS-III, finger tapping and pegboard primary outcomes reported). Later: the Brainsonix news page has no topline release; its 2026 items relay older or healthy-volunteer papers. Attacked the fit: the sponsor labels the trial an 'exploratory, double-blind, placebo-controlled, first-in-patient Phase 2a study' with a safety and tolerability primary endpoint, while the criterion asks for 'the Phase 2 trial' and its 'primary-endpoint result'. The attack fails: ClinicalTrials.gov NCT06693609 lists the study as Phase 2 and it is the only Phase 2 trial of EMP-01 in social anxiety disorder; the release (GlobeNewswire, 2026-02-26 07:00 ET) reports the primary endpoint (safety and tolerability through Day 43, met) and the LSAS efficacy result (placebo-adjusted -11.85 points, Hedges' g 0.45, p=0.036 one-tailed; 71 enrolled, 70 dosed, 69 completed) in the sponsor's own topline release, which the criterion names as the primary source. Web search finds no earlier disclosure of these results; the 'additional Phase 2a results' release came later. Direction is stored, not required. 2026-02-26 stands.

Strongest attack: the 2025-05-20 release reports Part 2 of Phase 2a study NCT05660642, whose Part 1 topline came in March 2024. Read as 'each trial counts once', that trial had already read out, which would leave three qualifying releases and make the event FALSE at the 2026-03-20 window end. I reject it: the counting window is 2025-03-20 to 2026-03-20, the March 2024 announcement falls outside and consumes no count, and the 2025-05-20 release is the sponsor's topline of a distinct study part. I also looked for a fourth release earlier than 2026-02-26 that would pull the date back. The BPL-003 alcohol-use-disorder Phase 2a topline is 2025-01-28 and the ELE-101 Phase 2a topline 2024-12-16, both before the window; the 2025-11-10 BPL-003 report is an open-label extension, excluded; VLS-01 topline is now guided to Q4 2026. Four stands, fixed on 2026-02-26.

An FDA written-response-only outcome counts when the sponsor reports it as that End-of-Phase-2 interaction. Attacked the date two ways. First, that the release states a meeting date earlier than the announcement: it does not. The 2026-03-03 release says only that the sponsor 'today announced a successful End-of-Phase 2 (EOP2) meeting' and cites minutes, with no meeting date or month, so the criterion's fallback applies and the announcement date counts. Second, that the sponsor said earlier that the meeting had been held: the Q4 and full-year 2025 results came on 2026-03-06 and the Investor Day release on 2026-03-10, both after. The release describes FDA feedback and alignment on a two-study Phase 3 programme, so it reports a held meeting, not a granted request. State and date stand. One evidence defect: the Investor Day item is recorded as 2026-03-03 but is dated 2026-03-10, and both ir.ataibeckley.com links did not resolve on recheck.

TRUE on the docket date of a complaint filed in a US federal district court within the window that (a) pleads a claim under ERISA for breach of fiduciary duty against the sponsor, plan committee or other named fiduciaries of an employer-sponsored group health plan over the plan's design or administration, whether brought by plan participants or by the Department of Labor, and (b) cites the Mental Health Parity and Addiction Equity Act (MHPAEA, 'mental health parity') as a basis of the alleged breach, as shown by the complaint text. A suit only for denied benefits under ERISA section 502(a)(1)(B) against an insurer or administrator, a state-court suit, or an amended complaint in a case filed before the window does not count. An earlier 2026 complaint fits the criterion as applied at least as well as H.N.: M.M. v. Aetna Life Insurance Co., Bank of America Corp., its Corporate Benefits Committee and its Group Benefits Program, W.D.N.C. No. 3:26-cv-00219, filed 2026-03-19. It names the employer as sponsor of a self-funded plan and the plan committee as administrator, pleads that they 'are fiduciaries of the Plan' (para 13) and 'breached their fiduciary duties' (para 66), and its Second Cause of Action, 'Violation of the MHPAEA (29 U.S.C. 1132(a)(3))', says 'these MHPAEA violations by Defendants are breaches of fiduciary duty' (para 78). H.N. (2026-03-26) instead concedes 'Marsh played no role in the decision' (para 3). Both are single-family benefit suits, not the Schlichter-style class actions in the readings; under that reading neither counts (RECAP shows no such 2026 suit). Under the criterion as written the first-true date moves to 2026-03-19, if in window; an earlier 2026 filing may exist outside RECAP.

The NBI is a named qualifying index, so the first qualifying announcement is Nasdaq's December 2025 notice, about five months before the Russell 3000 preliminary list of 2026-05-22. The Russell facts themselves stand: ATAI is on the 2026-05-22 preliminary list and the final list, effective 2026-06-29. Which date is first-true turns on the statement date, which I cannot see. If the statement predates the December 2025 announcement, the date moves to that notice; if it postdates it, ATAI was already an NBI constituent, NBI is excluded and 2026-05-22 stands.

Magstim's 2025-07-09 'pain' clearance is peripheral nerve stimulation held since K992911 (2000), not a new TMS condition. So under the criterion as written 2026-06-03 is right. But reading 5 says 'a new patient population for a listed disorder counts as a new indication', which makes K231926 (2024-03-22) the first-true date, 26 months earlier and possibly inside deadlines the criterion text resolves FALSE. Pa.: DiRenzo, Matozzo and PA Norris were indicted for conspiracy to unlawfully distribute Schedule II drugs through a voicemail refill line, a clinic prescriber and its principals, announced 2026-06-23 in the national takedown. S.D. Tex.: Crowder, Durham and pharmacist Onuaguluchi were indicted over two Houston pill-mill clinics and a Conroe pharmacy, 3.4 million pills; distinct docket, different companies. Neither is a Done Global superseding indictment. I found no dated earlier 2026 filing that moves the second-case date back; searches returned 2024-2025 cases, pleas and convictions in existing dockets. Residual risk: the sweep is not exhaustive, and the statement date is not shown, so 'filed after the statement date' stays unverified.

It is an Agreement and Plan of Merger signed 2026-07-15 and announced 2026-07-16, under which Lilly buys all shares for 6.75 US dollars plus a 2.50 CVR; the company is bought, not partnered with. The criterion also strikes out an equity investment or financing with no program agreement, which shows the drafter meant a narrow set of program deals. On that reading the state is not_occurred, because no other qualifying deal exists: the only big-pharma program agreement on record, Otsuka and Perception for arketamine, dates from 2021 and was terminated effective 2025-04-24. About 6,000 psychedelic clinics in Europe
E-0135
Criterion

Resolved on the named data series only: the count of European sites certified or registered to administer an approved psychedelic-assisted therapy (an MDMA or psilocybin medicine), per the certified treatment-centre list published under that medicine's controlled-distribution or risk-management plan on the European Medicines Agency medicine page and by the marketing authorisation holder, summed across approved medicines with duplicate sites counted once. 'Another 6,000' is a bare point number and takes the template's fixed band of plus or minus 20 percent: TRUE when the count at the deadline is 4,800 to 7,200, FALSE otherwise. If no such list has published 12 months after the deadline, the event is unresolvable. Realized values are stored, not scored.
