“I have it on good authority that the DEA is interested in reading all of our public comments as they were mandated to do by law. And if we get enough of them in, maybe they'll change something.”
Open letter to the author's wife urging her to file a public comment on the DEA proposed rule for telehealth prescribing of controlled substances (no schedule II without an in-person visit). He says the DEA will read the comments and that enough comments may lead the DEA to change the rule.
Intake
- EventA proposition written from a template on the asset, with a resolution criterion and a named public source, before the outcome is looked up. The same event resolves every person's items on it. Method ›
- DEA February 2023 proposed telemedicine controlled-substance rule is revised, withdrawn or replaced
- AreaOne of five topic classes: regulatory decisions, clinical trial outcomes, company and market outcomes, payer and policy, practice adoption. Every event has one area. Method ›
- Regulatory decisions
- DeadlineThe date by which the event must happen for the item to be true. It comes only from the person's words through the anchor table. Method ›
- None stated · undated panelItems with no deadline in the person's words, scored on a uniform 24-month window from the statement date. Part of the headline panel since rules 1.1.0; also shown on its own. Method ›, 24-month window to 22 Mar 2025
- Probability
- 0.50 LexiconThe fixed five-bin table that turns a phrase into a probability. The strongest phrase in the claim sentence decides; coders never read tone. Method › · binOne of five lexicon steps: A 'will' 0.90, B 'probably' 0.70, C 'may' 0.50, D 'unlikely' 0.30, E 'never' 0.10. A stated number goes to the nearest bin for calibration only. Method › C · “maybe they'll change something”
- Base rateThe probability a published external study gives an event of that class and stage, fixed at intake. Halved when the item window is shorter than the class median time to decision. Never learned from the ledger's own items. Method ›
- None in the table

- retrospective
- Coder BCohen's kappa: agreement between two coders beyond chance, from -1 to 1. Reported for admit, event, deadline, bin and asserts from the second-coder match test. Method ›
- admittedA statement that passed intake: sincere, the person's own claim, forward-looking, inside the five areas, and not excluded by a reason code. Only admitted statements become items. Method › · event E-0012 · deadline none · bin C
Registry entry
DEA revises, withdraws or replaces its February 2023 proposed rule on telemedicine prescribing of controlled substances rather than finalizing it as proposed.
TRUE on the Federal Register publication date of a DEA action on its February 2023 proposed rule on telemedicine prescribing of controlled substances without a prior in-person medical evaluation that departs from finalizing the proposal as written: a final rule whose operative requirements differ materially from the proposal (for example on the in-person evaluation requirement), a formal withdrawal of the proposal, or a new proposed rule that supersedes it. A temporary rule or order that only extends existing flexibilities while the proposal stays pending is not a revision, withdrawal or replacement of the proposal. FALSE on the Federal Register publication date of a final rule that adopts the February 2023 proposal without material change, and FALSE at the deadline when the proposal has been neither revised, withdrawn nor replaced. Resolution source: the Federal Register.

- Resolver note
- Criterion: FR publication of a DEA action on the Feb/March 2023 General Telemedicine NPRM (88 FR 12875, RIN 1117-AB40) that departs from finalizing it as written, including a new proposed rule that supersedes it; temporary extensions do not count. On 2025-01-17 DEA published a new NPRM under the same RIN and docket (DEA-407). It says DEA 'reevaluated its approach' after the 2023 comments, rejected the alternative of 'finalizing the proposed March 2023 General Telemedicine NPRM', and that the new proposal 'no longer contains an in-person medical examination requirement' or the 30-day supply limit. The Unified Agenda lists it as the revised NPRM of the same rulemaking. Applied as a superseding new proposal: occurred 2025-01-17. No formal withdrawal notice exists; the docket otherwise holds only temporary extensions (2023 to 2025) and no final rule through 2026-09-13.

Adversarial recheck
upheld (state): I argued that the 2023 proposal was never revised, withdrawn or replaced: no withdrawal notice exists, and the 2025-01-17 NPRM never uses the words withdraw, supersede or replace. The text of 90 FR 6541 defeats this. It is issued under the same RIN 1117-AB40 and docket DEA-407; it says DEA 'reevaluated its approach and determined that the best course of action was to proceed with the promulgation of a Special Registration rule', which 'no longer contains an in-person medical examination requirement for certain substances' nor the 30-day supply limit; and its Regulatory Alternatives section lists 'finalizing the proposed March 2023 General Telemedicine NPRM' as a rejected alternative. That is a new proposal that supersedes the 2023 one. The same-day VA final rule (90 FR 6523; RIN 1117-AB40; docket DEA-2023-0029) partially finalizes the rulemaking on different terms, also on 2025-01-17. Nothing earlier in the docket qualifies. Occurred on 2025-01-17 stands.
